Terms of Use

  1. Deliverymyway offers free delivery within the designated primary service area, referred to as Zone 1. Standard delivery will be made within 3-5 business days once the order is placed. myway offers Next Day and Second Day delivery within the primary service area at an additional charge as determined by myway. To qualify for Next Day service, orders must be placed by 3:00 pm Eastern Standard Time. For customers in our extended service area, referred to as Zone 2 and Zone3, myway reserves the right to assess additional charges based on the cost to service these areas. The primary and extended service areas are to be determined by myway and are subject to change.
    1. Conditions – Customer agrees to provide reasonable access to a safe and secure delivery location.
  2. Payment – All payment terms will be agreed upon before the order is finalized. myway will not deliver SafeBox(es) until payment terms are agreed to. Customer will provide payment information at the time of placing an order. Customer agrees to pay in full all amounts due at the time of order placement. There is a 60 day minimum charge for each SafeBox ordered. myway will notify the customer at least 30 days prior to any price change. myway will charge the customer's account on the first business day of each month for one month's rental per SafeBox for active service. myway will assess the customer a pro-rated amount at the beginning of the storage term and at the end of the storage term based on actual number of days used per SafeBox by customer. Any amounts (over the minimum) that are overcharged will be credited back to the customer at the time of service termination. The pro-rated amount at the beginning of the storage term will be charged on the day of delivery of SafeBox(es) to customer. If any credit is due to customer at the end of the storage term the pro-rated amount will be credited on the day that myway picks the empty SafeBox(es.)
  3. Use of Service
    1. Prohibited Items - Customer agrees to adhere to the definition of “Prohibited Items” as stated by myway and defined here. The prohibited items include, but are not limited to, the following: acid, gasoline, poisons, charcoal, fertilizer, paints, stains, matches, lighter fluid, nail polish and remover, ammunition, firearms(loaded or unloaded), fireworks, pool chemicals, motor oil, batteries, ammonia, propane tanks, cleaning fluid; any hazardous, toxic, radioactive, explosive incendiary or highly flammable or combustible materials or items; any materials classified as class IV commodities or high hazard commodities under the Uniform Fire Code Act; any aerosol can or products contained in high pressure cans; any type of fire starter; any gas or liquid fuel; any material that is hazardous, flammable or combustible; any type of perishable stock or food, live plants or living or dead organisms; any high value items including money, securities, and highly sentimental items whose value is not easily determined and cannot be replaced. Any person or animal taking residence inside of the SafeBox is strictly prohibited.
    2. Customers obligation – The customer is solely responsible for and assumes all risks in relation to:
      1. Loading and unloading the SafeBox, which includes packing the contents properly and securely to prevent any movement or shifting in the course of normal transportation. myway SafeBox(es) has a 2,000 lb. weight limit that the customer is not to exceed per any one SafeBox.
      2. Padlock the SafeBox(es) with their own padlock or by purchasing one through myway.
      3. Accepts responsibility for any damage done to property (whether customers or not) that may be done by myway during the course of delivery or pick up.
      4. myway customer shall not make any alterations to the SafeBox and/or cover, or attempt to move the SafeBox once it has been placed by myway. The SafeBox shall only be moved by a myway Delivery Manager using the proper equipment.
      5. Customer shall not sublease or transfer ownership of SafeBox(es).
      If the customer fails to comply with any customer obligation or any part of this agreement they agree that myway will not be held liable related to the liability provisions within this document.
  4. Liability – From time of delivery until myway has picked up the SafeBox(es), the customer is fully liable for any loss, theft, or damage to the contents or SafeBox(es) and cover, or to any other property or party relating to or arising from the placement, location, use or contents of the SafeBox(es). myway shall not be held liable for any indirect, incidental, special or consequential damages arising from any breach of an express or implied warranty. myway is not liable for any damage, loss or theft of prohibited items or from damage due to acts of God. The customer agrees to indemnify and hold harmless myway and all of its owners, directors, employees, and its affiliates in any of the events contained herein.
  5. Right of entry and disposal – Property contained in a SafeBox by customer shall be subject to a lien if rental monthly payments are delinquent. Without limiting the right of myway to conclude that excessive non-payments by the customer and failure to communicate any alternative payment method shall be deemed as abandonment by customer. After 10 days of non-payment a finance charge of 1% of the past due balance will be applied for each day the account is in delinquent status after such period. After 30 days of non payment, the account will be suspended and all applicable charges will be applied to customers account. If after 60 days, the customer has not made alternate payment arrangements and no form of payment has been received by myway, myway will assume ownership of contents in the SafeBox(es). myway will dispose of contents by public sale upon such terms and conditions are reasonable. Two weeks before any such sale, myway will serve final notice to customer to include myway's intentions. myway requests that you provide us with an alternate contact, where in such instances we cannot reach said customer, we may contact the alternative to send notice.
    1. Civil Relief Actmyway requires you to inform us in writing if you are an active member in any branch of the U.S. Military. With such information myway will determine the applicability of the Civil Relief Act.
    2. Request for Informationmyway customer hereby authorizes myway to release any information in regards to customer or contents of customer's SafeBox as may be required by law or government agencies, or court rulings.
  6. Waiver Alterations – Not under any circumstances or by any means shall any terms be altered or conditions waived without written agreement with myway.
  7. Movement of SafeBox(es) – Customer agrees that myway has the right to choose to relocate said SafeBox(es) to a different Security Hub without prior notice. If such a move should take place the customer will be notified in writing within 14 days of such an event. If the customer requests a relocation to a different myway Security Hub, myway reserves the right to charge a fee if applicable.
  8. Termination of Service – Customer shall provide myway with verbal or written notice in regards to terminating service. Customer agrees to give a minimum of 3 days notice to myway for termination of service. The rental agreement will be terminated when the SafeBox is picked up empty by myway from customer's property or if the customer has emptied out the SafeBox at myway's Security Hub, provided they have given the required notification of termination. The final day of billing will be the date that myway is in possession of the empty SafeBox(es).
